
STV Player+ Terms & Conditions
These Terms and Conditions set out the agreement between you and STV Central Limited, a company registered in Scotland no. SC172149, with registered office at Pacific Quay, Glasgow, G51 1PQ (“we”, “us”, “STV”). These Terms and Conditions set out the terms on which you are entitled to access and use the STV Player+ service.
By subscribing to the STV Player+ service, you agree to be legally bound by these Terms and Conditions, which contain important information about your rights and responsibilities. These Terms and Conditions incorporate the STV Terms of Use (available at stv.tv/terms) which you also agree to by subscribing to STV Player+. If you do not agree with any of these Terms and Conditions, then you should not subscribe to STV Player+.
In the event that there is any inconsistency between these Terms and Conditions and the STV Terms of Use, these Terms and Conditions will prevail.
For information about how we process your personal data and how we use cookies and similar technologies, please see our Privacy Policy (available at stv.tv/privacy) and Cookie Policy (available at stv.tv/cookies).
Please also note that we may update or change these Terms and Conditions from time to time, so please take a fresh look every so often. If you continue to use the STV Player and STV Player+ then you agree to be bound by such updates and changes.
1) What is STV Player+?
1.1 STV Player+ provides you with access to additional functionality in relation to Content available on STV Player, including the ability to watch on-demand programmes without ad breaks and download programmes on a temporary basis to watch offline. Please note that the restrictions in section 1.7 below apply.
1.2 A subscription to STV Player+ is charged on a monthly or, where available, annual basis, depending on your selected subscription plan. Please see our help and support page for more detail.
1.3 Where we refer to “Content” in these Terms and Conditions, we mean the programmes, video, audio, text, trade marks, logos, images and other audio-visual content (and metadata therein) either owned by us or licensed to us to use on the STV Player.
1.4 To subscribe to STV Player+ you must:
- register for an STV Player account (see the STV Terms of Use at stv.tv/terms);
- be a UK resident and aged 18 years or older; and
- subscribe to STV Player+ when presented with our plan options.
1.5 Please keep your log-in details to the STV Player service confidential. Do not allow anyone else to use them. You are responsible for keeping them safe and you are responsible for all activity that occurs under your log-in details.
1.6 Content is made available to you for your own personal and non-commercial use only. You may not transfer your rights or obligations under these Terms and Conditions to anyone else.
1.7 It is important to note the following conditions that apply to the STV Player+ service:
- The STV Player+ functionality is not available for our “Watch Live” simulcast of our television broadcast channel, therefore “Watch Live” will still contain ads, sponsorship messages and promotional trailers.
- The STV Player+ functionality that allows you to watch on-demand programmes without ad breaks is only available through selected platforms. Please refer to our help and support page for the list of platforms on which you can access this functionality. Please note this list of platforms may change from time to time.
- Some on-demand Content (i) will contain sponsorship messages and ads for contractual reasons and (ii) may contain promotions for other programmes and STV services.
- Temporary download functionality is only available on our STV Player mobile apps and may not apply to certain programmes due to licensing restrictions.
- You can stream Content available through your STV Player account on up to three devices simultaneously.
- There may be differences in the Content available via the free version of the STV Player and available on STV Player+ as a result of rights restrictions imposed on us.
1.8 To watch Content, you must:
- access your STV Player account through a compatible device. Please refer to the list of devices on which you can access STV Player on our help and support page. To access the STV Player+ functionality, please access your STV Player account through one of the platforms listed on our help and support page. Please note that these lists of devices and platforms may change from time to time;
- have an active broadband internet connection or mobile network connection; and
- ensure that your equipment, systems and connectivity are sufficient. Please see our help and support centre for further information.
1.9 We cannot guarantee that your use of the STV Player and/or STV Player+ will be uninterrupted or error free. In particular, we do not take responsibility for issues outside our control, including but not limited to internet or connection issues. Access to the STV Player and/or STV Player+ may be suspended temporarily and without notice for operational reasons and/or to allow maintenance or repair.
2) Automatic Renewal, Billing and Price Changes
2.1 You can choose to subscribe to STV Player+ by selecting either a monthly subscription plan or, where available on the sign-up platform, an annual subscription plan. You will be enrolled onto a recurring payment plan which will automatically renew at the end of every monthly or annual subscription period (depending on your selected plan) unless cancelled in accordance with section 3 below.
2.2 If you benefit from a free trial, your selected payment method will be automatically charged immediately after your free trial period ends. If you do not benefit from a free trial, your selected payment method will be charged on the first day of your subscription to STV Player+.
2.3 Payment will recur to your selected payment method on the same day of each month or on the same date of each year (depending on your selected plan), each known as a “renewal date”. If that date does not occur in a particular month, the payment will instead be charged on the last date of that month. For example, if you subscribe to STV Player+ on a monthly subscription plan and your first payment is taken on 31 January, your next payment will be taken on the 28 February, or 29 February if it is a leap year.
2.4 If a payment is not successful for any reason, for example because your selected payment method has expired or because you have insufficient funds in your account, we may cancel or suspend your access to the STV Player+ functionality until we have received payment. Where a payment is not successful, our payment processor will notify you by email and may retry the payment up to 4 times in the 7-day period following the failed payment. Where we have not received payment in the 7-day period, we will cancel your subscription.
2.5 You can change your payment method associated with your STV Player+ subscription on the stv.tv website by logging onto your account at stv.tv and accessing the “Payment details” section of your account page under “Subscription & billing”. It is your responsibility to update and maintain your payment method.
2.6 If you subscribe to STV Player+ through our app via a third party (for example, an app store or platform), then your subscription relationship is with that third party and separate terms will be agreed with you which will apply in addition to these Terms and Conditions. Where there is any inconsistency between the provisions dealing with payment, auto-renewal, billing and cancellation rights in the applicable third party’s terms and these Terms and Conditions, the provisions in the applicable third party’s terms will prevail.
2.7 We may change the price of our subscription plans to STV Player+ from time to time for any reason. However, we will notify you at least 30 days in advance of the change by sending an email to the email address you used to register for your STV Player account that carries your STV Player+ subscription. If you do not want to continue your subscription at the new price, you must cancel your subscription at least a day before your next renewal date. If you subscribe to STV Player+ through our app via a third party, the process followed by the third party to effect a price change may differ from STV’s process. In that event, the terms relating to a price change as set out in your agreement with the third party will apply.
2.8 You are responsible for any costs and other charges or expenses charged by your Internet Service Provider or network operator in relation to your internet service and your mobile service.
3) Cancellation
3.1 You can cancel your subscription at least a day before your next renewal date and the cancellation will take effect at the end of your current subscription period.
3.2 If you cancel part way through a subscription period (either monthly or annual) you will not receive a refund, but you will continue to have access to the STV Player+ functionality until the end of your current subscription period. We do not refund or credit for partially used subscription periods (except for credits issued in accordance with sections 4.2 or 4.3 below).
3.3 You authorise us to charge your payment method stored on your account if you decide to reactivate your subscription during the remainder of your current subscription period.
3.4 You can manage (including cancel) your STV Player+ subscription on the stv.tv website by logging onto your account at stv.tv and accessing the “Manage subscription” section of your account page under “Subscription & billing” where you can get details of your current subscription plan, switch to a different plan, change your payment method and cancel your subscription. If you subscribe to STV Player+ through our app via a third party (for example, an app store or platform), you must refer to the terms of their cancellation process. Please visit our help and support page for instructions on how to cancel. You acknowledge that STV cannot cancel your STV Player+ subscription with any third party on your behalf.
3.5 Our above cancellation terms do not affect the statutory right to withdraw from a contract within 14 days from the date on which the contract is entered into. This is known as the “cooling-off period”. However, when you purchase a subscription from us, you agree that you can access your subscription immediately and you will be asked to acknowledge that this means you will lose your statutory right to withdraw from this contract and receive a refund within the 14-day cooling-off period.
3.6 If you subscribe to STV Player+ through our app via a third party (for example, an app store or platform), you must refer to the terms of their cancellation process during any applicable cooling-off period.
4) Upgrading your Subscription Plan or Amending your Payment Plan
4.1 You may upgrade your STV Player+ subscription plan to our “STV Player+ with Access to Selected Premier Sports Content” subscription plan in your account. You can do this in the “Manage subscription” section of your account page under “Subscription & billing”. If you wish to upgrade, you must enter into a new subscription agreement. As soon as you complete the upgrade process, your current subscription plan will be cancelled immediately, and your new subscription plan will start. You authorise us to charge your payment method stored on your account. You will lose any remaining free trial period, and you will lose the benefit of any promotional offer that applies to your current subscription.
4.2 If you choose to upgrade your subscription plan part way through a subscription period, we will apply a credit equal to the unused portion of your last subscription payment which will be deducted from the first payment of your new upgraded subscription plan.
4.3 You may, where the option is available to you, amend your STV Player+ subscription from a monthly plan to an annual plan. Where this option is available to you, you can do this in the “Manage subscription” section of your account page under “Subscription & billing”. If you choose to enter into an annual plan, your monthly subscription plan will be cancelled immediately, and you must enter into a new annual subscription agreement. If you are part way through a monthly subscription period, we will apply a credit equal to the unused portion of your last monthly subscription payment which will be deducted from the cost of your new annual subscription plan. You authorise us to charge your payment method stored on your account.
4.4 If you subscribe to STV Player+ through our app via a third party (for example, an app store or platform), please refer to the third party for further details on the availability, process and consequences of upgrading or changing your subscription plan, as their terms will apply
5) Free Trial
5.1 Your subscription to STV Player+ may begin with a free trial. We will inform you of the specific duration of any free trial period at the point of signing up to your STV Player+ subscription. For example, we may choose to offer a 7-day free trial to new subscribers to STV Player+ from time to time. Availability of a free trial is not guaranteed and, if one is available, it is only available to those who have not previously used a free trial for STV Player+ (one free trial per subscriber). Where your subscription starts with a free trial period, the terms of this section 5 apply.
5.2 You will need to provide a valid payment method at the point of signing up to STV Player+. Your free trial period will start once you have completed the sign up process to your STV Player+ subscription.
5.3 Your selected payment method will be automatically charged immediately after your free trial period ends. You can cancel your subscription at least a day before the end of your free trial period to avoid being charged and the cancellation will take effect at the end of your free trial period.
5.4 We will notify you by email that your free trial period is ending and that your recurring payment will be taken unless you choose to cancel your subscription. If you subscribe to STV Player+ through our app via a third party (for example, an app store or platform), then your subscription relationship is with that third party and subject to its terms. That third party may have a different notification process in relation to any applicable free trial period ending.
5.5 You agree not to register multiple times for a free trial using multiple names, email addresses or other means. Any such action shall be a breach of these Terms and Conditions and may result in cancellation of your subscription to STV Player+.
6) Other Offers and Promotions
6.1 We, or our third-party partners, may make available voucher or promotional codes, discounts or other promotional offers which may offer you free or discounted access to the STV Player+ service (“Promotional Offers”). Promotional Offers may take a variety of forms and may be made available on a standalone basis or provided as part of a bundle with other products or services sold by us or third-party partners.
6.2 You may only use and redeem Promotional Offers in accordance with the specific terms and conditions which apply to them. Please check the relevant terms and conditions of the Promotional Offer for full details, including the restrictions that apply.
6.3 You agree not to register multiple times for the same Promotional Offer using multiple names, email addresses or other means.
7) Amendments to the Content/STV Player+ service
The availability of Content and additional functionality via the STV Player+ service is subject to change from time to time. You agree that STV reserves the right (at any time and for any reason) to: (i) remove and/or amend the Content and/or functionality available as part of the STV Player and/or STV Player+; and/or (ii) discontinue STV Player+ (or any part thereof), each with or without notice and STV will not be liable to you or any third party should STV exercise any such rights. In the event that STV Player+ is discontinued, we will aim to let you know at least 30 days in advance and we will refund you any undelivered paid period of your current subscription.
8) Geo-restrictions
8.1 We apply "geo-blocking" measures to prevent access to some Content in cases where rights restrictions apply. Specifically, there is some Content which will not be accessible if you are located outside the Central and North regions of Scotland (where we broadcast our Channel 3 service), and/or outside the United Kingdom.
8.2 You agree not to disable, circumvent or otherwise interfere with any geo-blocking measures or to access, or attempt to access, such Content if you are located in areas to which we have prevented access.
9) How may I use STV Player+?
9.1 You agree that you will at all times comply with these Terms and Conditions and will only use STV Player+ for your own personal and non-commercial use, and for lawful purposes, and in a manner that does not infringe the rights of third parties, or restrict or inhibit the use and enjoyment of the STV Player+ service or functionality by any other user.
9.2 We may use technical measures and security systems for the security and protection of STV Player and/or Content. You agree not to bypass, attempt to circumvent or interfere with any such technical measures or security systems, or attempt to test, damage or otherwise affect the security of STV Player, STV Player+ or Content, or unlawfully access, or use, our servers, systems or Content, nor to attempt to do so. Any violation of this section 9.2 shall be considered a material breach of these Terms and Conditions, entitling us to immediately suspend or terminate your access to STV Player and/or STV Player+, or otherwise prevent continued unauthorised actions.
9.3 You agree you shall not and shall not allow third parties to:
- access or subscribe to STV Player+ using a virtual proxy network;
- display, publish, copy, licence, perform publicly or communicate to the public the STV Player, STV Player+ service or functionality and/or Content (or any part of them), other than as expressly permitted in accordance with these Terms and Conditions or applicable law;
- de-compile, reverse engineer, reproduce, copy, distribute, frame, modify, create derivative works from, provide access to, license, rent, lease, lend or sell STV Player and/or STV Player+ and/or the Content (or any part of them) in any way, other than as expressly permitted in these Terms and Conditions;
- disable, circumvent, or otherwise interfere with any geo-blocking software or content protections;
- do anything that brings (or in our opinion is likely to bring) STV into disrepute;
- embed, frame, upload, or make STV Player, STV Player+ (or any part of it) or any of the Content available via any third party platform, website or service without STV’s prior consent;
- copy, reproduce or otherwise publish any of STV’s trade marks or logos.
Any violation of the terms set out above in section 9.3 shall be considered a material breach of these Terms and Conditions, entitling us to immediately suspend or terminate your access to STV Player and/or STV Player+, or otherwise prevent continued unauthorised actions.
9.4 STV Player, STV Player+ and the Content is protected by copyright, trade mark, and/or other proprietary intellectual property rights owned by or licensed to us. Nothing in these Terms and Conditions confers any intellectual property rights in or to the STV Player, STV Player+ and/or the Content to you other than a limited, non-exclusive, non-transferable, revocable licence to access and use STV Player and STV Player+ in the UK (in accordance with the Geo-restrictions set out in section 8) for your personal and private use (and not for any commercial purpose) and strictly in accordance with these Terms and Conditions and applicable copyright law.
10) Breach of Terms and Conditions
10.1 STV reserves the right to suspend, restrict or terminate your access to the STV Player and/or STV Player+ service at any time if we believe that you have breached these Terms and Conditions. STV also reserves the right to take legal action against any such breach.
10.2 We exclude any liability for lawful actions taken by us in response to breaches of these Terms and Conditions.
10.3 You agree to compensate STV in respect of any damages suffered by us or any losses resulting from any claim made by a third party in respect of any matter arising from your use of the STV Player and/or STV Player+ service in breach of these Terms and Conditions or as a result or your violation of applicable laws.
10.4 If you breach any of these Terms and Conditions, and we choose not to take action against you, that does not necessarily mean that we will waive any subsequent breaches by you. In addition, if we do not exercise the entire remedy available to us, we may still do so at a later date.
11) Third party platform operators and links to third party services
11.1 You are solely responsible for evaluating the integrity of the operators of any third party websites accessed through the STV Player; the accuracy and completeness of any information contained on them; the value and authenticity of any goods or services offered through them, and their data collection and use policies.
11.2 These Terms and Conditions govern only your relationship with STV and not with any third party. You should check the applicable third party’s website for details of the terms and conditions governing your relationship with that third party. Your use of our STV Player+ service may also be subject to usage rules imposed on you by the platform through which you access the STV Player, for example if you use the STV Player iOS app, you may be subject to Apple’s usage rules or if you access the STV Player through your Roku device, you may be subject to Roku’s usage rules. You acknowledge and agree that to the extent permitted by applicable law, neither Apple nor Roku nor any other platform provider of the platform through which you lawfully access the STV Player has any responsibility or liability to you with respect to your use of the STV Player or any content or functionality therein and is not obliged to provide any support services relating to the STV Player.
12) Limitation of Liability
12.1 STV Player+ is provided on an “as is” and “as available” basis. We cannot guarantee that the STV Player, STV Player+ service, or the Content will be free from bugs, viruses or errors or that your access will be uninterrupted (for example, we may need to temporarily suspend the service without notice to carry out maintenance or updates or due to events beyond our reasonable control).
12.2 STV is not responsible for any lack of access to functionality or failure of the STV Player or STV Player+ service as a result of (i) your failure to download the latest version of the STV Player app, meet the compatibility requirements set out in our help and support page on STV Player supported devices (as may be amended from time to time) or, in respect of access to STV Player+ functionality, access STV Player through one of the platforms listed in our help and support page on subscription supported devices (as may be amended from time to time); or (ii) your device, equipment, operating system or internet connection.
12.3 In addition to other specific exclusions of liability set out in these Terms and Conditions, we do not accept any liability for:
- any damage or loss caused to you while using the STV Player or STV Player+ service in breach of these Terms and Condition including but not limited to where you are using our services for purposes other than your own personal, non-commercial use;
- any failure, suspension and/or termination of access to the STV Player, STV Player+ service and/or any Content in connection with or arising out of an event which is outside our reasonable control (including but not limited to strikes, lock-outs or other industrial disputes, nuclear accident or acts of God, war or terrorist activity, riot, civil commotion, malicious damage, compliance with any law or government order, rule regulation or direction, accident or breakdown of plant or machinery, fire, flood, storm or default of suppliers, and where they are beyond our reasonable control, any other acts, events, omissions or accidents);
- incompatibility of the STV Player or STV Player+ service with any other software or hardware;
- any claims brought against you by a third party; and/or
- any damage or loss caused to you where such damage or loss (i) is not reasonably foreseeable to you and us when you use the STV Player or STV Player+ service or (ii) is reasonably foreseeable to you and us but is only indirectly related to your use of the STV Player or STV Player+ service; in both cases including where the damage or loss results from our breach of these Terms and Conditions.
12.4 Nothing in these Terms and Conditions:
- excludes or limits our liability for death or personal injury caused by our negligence or that of our employees or agents or for fraudulent misrepresentation by us or our employees or agents; or
- restricts your statutory rights as a consumer under applicable laws.
12.5 Except in relation to section 12.4 above, and to the fullest extent permitted by applicable laws, in no event will our total liability to you for all damages arising from your use of STV Player+ exceed the amount you have paid for STV Player+ in the 12 months preceding your claim.
13) Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with Scots law. All disputes arising from them shall be submitted to the non-exclusive jurisdiction of the Scottish courts.
